Terms of Service

1. Agreement

These Terms of Service (“Terms”) cover the Smart Grocer website at https://smartgrocerapp.com, the Smart Grocer app, and related pages such as delete account, feedback, and password reset (together, the “Service”). Our Privacy Policy is part of these Terms.

The Service is operated by Bentley Williams (“we,” “us,” or “our”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

Smart Grocer compares grocery prices and helps you optimize a shopping list. We do not sell groceries. Prices can be wrong, late, or incomplete. Check the price in the store before you buy. We are not a party to your purchases from retailers.

3. Beta

The Service is in beta. Features and retailers can change, pause, or stop. That is a term of using the Service today.

4. Eligibility

You must be at least 13 years old. If you are under 18, you may use the Service only with a parent or guardian’s permission. The Service is intended for the United States.

5. Accounts

Creating an account collects the information described in our Privacy Policy: name, email, home address, location choice, at least two stores, and dietary preferences. You agree to give accurate information, keep your login credentials safe, and tell us if you think someone else has accessed your account.

You can delete your account at any time, as described in the Privacy Policy and on the delete account page.

6. Acceptable use

You agree not to:

• Use the Service in a way that breaks the law or these Terms
• Access the Service, another account, or our systems without authorization
• Scrape, crawl, or reverse engineer the Service, except where the law allows it
• Disrupt the Service, including with excessive automation
• Use a false identity or submit information you know is false
• Harass, abuse, or harm anyone
• Resell or sublicense the Service without our written permission

We may suspend access if you break these Terms.

7. Your content

You own your grocery lists, trip data, and feedback. You give us a limited, worldwide, non-exclusive, royalty-free license to host, process, and display that content only to operate and improve the Service.

8. Subscriptions

Paid billing through the Apple App Store or Google Play is not offered yet. When it launches, the store’s price, renewal, cancellation, and refund rules control, and we will update this section before those purchases go live. Older Stripe web billing does not govern future store purchases.

9. Intellectual property

The Service is owned by Smart Grocer and its licensors. We give you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial use. These Terms do not let you use our trademarks except as needed to use the Service.

10. Privacy

Our Privacy Policy explains what we collect and how we use it.

11. Disclaimers

The Service is provided “AS IS” and “AS AVAILABLE.” We disclaim warranties, including merchantability, fitness for a particular purpose, non-infringement, price accuracy, and uninterrupted service, to the fullest extent the law allows.

12. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for a claim is capped at the greater of (a) the amounts you paid us in the 12 months before the claim or (b) fifty US dollars ($50).

Some jurisdictions limit these exclusions. In those places, the limits apply only as far as the law allows.

13. Indemnity

You will indemnify Smart Grocer and its operator against claims, damages, and expenses, including reasonable attorneys’ fees, that arise from your misuse of the Service or your violation of these Terms.

14. Suspension and termination

We may suspend or terminate your access if you breach these Terms. You may delete your account at any time.

15. Governing law

These Terms are governed by the laws of the United States and the State of South Dakota, without conflict-of-law rules, except where store rules or consumer law require otherwise.

16. Changes

We may update these Terms. The Last updated date at the top will change when we do. Continued use of the Service after an update is acceptance of the new Terms, where the law allows that.
